Creditors and Probate

Creditors have rights when someone dies. They can bring a claim against the estate to be paid, and they can even open an estate at court if the Executor doesn’t open the estate in a timely manner.

If you’re an executor or the person closest to the deceased person, make sure you develop a list of creditors and bills owed by the deceased person, monitor the mail, and talk with the estate’s attorney about any known creditors.

Do NOT agree to make any payments or “take care” of any debts. Just gather information and talk to an experienced estate attorney.
